Legal Status of CBD in the UK and EU Cannabidiol (CBD) is not listed as a controlled substance under the Misuse of Drugs Act 1971 and therefore is legal. As per the MHRA’s (Medicines & Healthcare products Regulatory Agency) opinion provided to Cannabis Trade Association UK (CTA UK) in September 2017, CBD products that do not market any medical claims are subject to regulations under the food law and therefore can be sold in the UK as food supplement. All food supplements must comply with the Food Standards Agency requirements in regards to labelling and information displayed for consumers. If any of the CBD products makes such claims then a licence from Medicines and Healthcare products Regulatory Agency (MHRA) is required.
